In the ICC Termination Act (ICCTA), to protect railroads from a patchwork of state and local regulations, Congress granted the Surface Transportation Board exclusive jurisdiction over “rail transportation.” In the Federal Rail Safety Act (FRSA), Congress expressly preempted most state and local laws that seek to regulate rail safety. While extremely broad in their preemptive scope, ICCTA and FRSA preemption are not unlimited and railroads are subject to a constant effort to chip away at preemption. This panel will explore the scope of preemption and challenges to its scope, including with respect to crew size, locomotive air emissions, construction, blocked crossings, passenger excursions, land use, and the maintenance and upkeep of facilities including bridges and rail right of way.
